Terms of Service

1. Acceptance of Terms

By creating an account, subscribing to, or otherwise using Heybudo ("Heybudo," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service.

2. Description of Service

Heybudo is a $29/mo subscription service that provisions each subscriber a personal AI agent cloud server, accessible via a dedicated subdomain. The service includes account management, billing, server provisioning, and ongoing hosting of your agent.

3. Accounts & Registration

You may create an account with an email and password or by signing in with Google. You are responsible for providing accurate registration information and for maintaining the security and confidentiality of your account credentials. Notify us immediately at support@heybudo.ai if you suspect unauthorized access to your account.

4. Subscription, Billing & Cancellation

Heybudo is billed at $29/mo on a recurring basis through our payment processor, Stripe. Your subscription automatically renews each billing cycle until cancelled. You may cancel anytime through your account settings; cancellation takes effect at the end of the current billing period, after which your provisioned agent server will be deactivated and may be deleted. Except where required by applicable law, fees already paid are non-refundable.

5. User Content & Your Provisioned Server

You retain ownership of the content and data you store on or generate through your provisioned agent server. You are solely responsible for the actions your agent takes and the content it produces or accesses. Heybudo hosts and operates the underlying infrastructure but does not control how you configure or direct your agent.

6. Acceptable Use

Your use of Heybudo, including your provisioned agent server, is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations of the Acceptable Use Policy may result in suspension or termination of your account.

7. Intellectual Property

Heybudo and its licensors retain all right, title, and interest in and to the Heybudo platform, software, and branding. These Terms do not grant you any rights to Heybudo's trademarks, logos, or proprietary technology beyond what is necessary to use the service.

8. Third-Party Services

Heybudo relies on third-party providers to deliver the service, including Stripe for payments, Google for OAuth sign-in, and hosting and DNS providers for server provisioning. Your use of the service is also subject to our Privacy Policy, which describes how these providers process your data.

9. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied. Heybudo does not guarantee uninterrupted or error-free operation of the service or your provisioned agent server.

10. Limitation of Liability

To the maximum extent permitted by law, Heybudo's total liability arising out of or relating to these Terms or the service shall not exceed the total fees you paid to Heybudo in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold Heybudo harmless from any claims, damages, or expenses arising out of your use of the service, your provisioned agent server, or your violation of these Terms or the Acceptable Use Policy.

12. Termination

Either party may terminate these Terms at any time; you may do so by cancelling your subscription. We may suspend or terminate your account, including your provisioned agent server, if you violate these Terms or the Acceptable Use Policy.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
